Agreement to Terms

By accessing or using FundrCat, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

Use License

Permission is granted to temporarily use FundrCat for personal, non-commercial fundraising purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the platform materials
• Use the materials for any commercial purpose outside of approved fundraising activities
• Attempt to decompile or reverse engineer any software contained on FundrCat
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

Account Registration

To use certain features of FundrCat, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Immediately notify us of any unauthorized use of your account
• Be responsible for all activities that occur under your account

Fundraising Guidelines

When conducting fundraisers on FundrCat, you agree to:

• Conduct fundraising activities honestly and ethically
• Accurately represent your organization and fundraising purpose
• Fulfill all commitments made to supporters and purchasers
• Comply with all applicable laws and regulations regarding fundraising
• Not use the platform for fraudulent or deceptive purposes
• Ensure all product descriptions and pricing are accurate

Payment and Fees

All payments are processed securely through Stripe. You acknowledge and agree that:

• Platform fees will be deducted from sales as outlined in your agreement
• Commission rates are set by your organization and shown transparently
• All prices are in US dollars unless otherwise specified
• Sales are final unless otherwise specified by your organization's refund policy
• You are responsible for any taxes applicable to your fundraising activities

Product Delivery

FundrCat facilitates online ordering for local, hand-delivered fundraiser products. Organizations are responsible for:

• Coordinating product delivery or pickup with purchasers
• Ensuring products are delivered in good condition
• Managing any product quality issues or complaints
• Maintaining accurate inventory and availability information

User Conduct

You agree not to:

• Violate any laws or regulations in your use of FundrCat
• Infringe on any third party's intellectual property rights
• Harass, abuse, or harm another person or organization
• Submit false, misleading, or fraudulent information
• Interfere with or disrupt the platform or servers
• Attempt to gain unauthorized access to any systems or networks
• Use automated systems or bots to access the platform

Intellectual Property

The FundrCat platform, including its original content, features, and functionality, is owned by FundrCat and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not use our trademarks, logos, or branding without our prior written consent.

Termination

We may terminate or suspend your account and access to FundrCat immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms of Service. Upon termination, your right to use the platform will immediately cease.

Disclaimer of Warranties

FundrCat is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the platform's operation or the information, content, or materials included. You expressly agree that your use of FundrCat is at your sole risk.

Limitation of Liability

In no event shall FundrCat, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use FundrCat.

Indemnification

You agree to defend, indemnify, and hold harmless FundrCat and its licensors, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of FundrCat or violation of these Terms.

Dispute Resolution

Any disputes arising out of or relating to these Terms of Service or use of FundrCat will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action lawsuit.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of FundrCat after any changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
